In order to obtain private insurance in the state of Maryland you generally have to fill out an application. The insurance company will then take the information on the application and use it to determine whether or not they will insure you. There is a possibility that the insurance company will deny coverage to you and/or your family due to the information provided. The Maryland Department of Insurance has given the insurance companies that right in the laws they have set forth that insurance companies operating inside the state lines operate under.
If the insurance company decides that they will provide you with health insurance coverage the law also allows for them to attach riders or waivers to your policy for certain medical conditions. What this means for you as the insured is that medical conditions that you have before obtaining your health insurance policy, and the treatment for symptoms that are associated with the previous condition, could be excluded from your coverage under these riders.
The Maryland Department of Insurance has placed a time limit on how many months an insurance company can look back in your medical history for pre-existing conditions. Along with the 84 month look back limit they have also set a 24 month exclusionary period limit for pre-existing conditions. The only type of policies that this may not affect are HMO policies. Maryland insurance laws also state that the insurance company must give credit for prior coverage to you if you are exercising your rights under HIPAA.
